Conditions of Purchase

The formalisation of the order implies, in any case, the acceptance of the present purchase conditions. This formalisation is understood once the confirmation email has been received with the details of the purchase made by the user. 

Product availability

All orders are subject to the availability of the products, therefore, if there are any incidents regarding their supply or if there are no products left in stock, the client will be informed immediately, and the amount of the product or products out of stock will be refunded. 

In this case, GTI will refund the corresponding amount without undue delay by the same means of payment with which it was paid. In the event that a product is not available, but others within the same order, the user will be informed by telephone or email of the partial cancellation of the order. 

The partial cancellation of the order due to unavailability does not entitle the user to the cancellation of the entire order. If, as a result of this cancellation, the customer wishes to return the delivered product, he/she must follow what is stipulated in the returns section. 

Prices

The applicable prices are those indicated on the website on the date of the order. Likewise, the products added by the user in the basket will always reflect the most recent price shown on the product details page. 

The prices shown on each item include VAT (Value Added Tax), IGIC (Canary Islands General Indirect Tax), IPSI (Tax on Production, Services and Imports in Ceuta and Melilla), or the taxes payable in accordance with the applicable regulations from which the purchase is made, as applicable. 

If an error is detected in the price of any product you have ordered before we send it to you, even if you have received the email confirming the purchase, we will proceed to rectify it immediately, so that if the correct price is lower, we will refund the difference and if the correct price is higher we will contact you and offer you the option of confirming the order at the correct price or cancelling the order. 

The amount of the shipping costs will be indicated to the customer at the time the order is placed. 

Methods of payment

The user agrees to pay for the purchase at the time the order is placed. 

The proof of purchase will be available and can be viewed in the “My account” section under “Orders” on the website, as well as in the confirmation email formalising the purchase. 

The user must pay the amount corresponding to their order by any of the means available at the time of purchase, preferably by credit or debit card (Visa, Mastercard, American Express, Visa Electron and/or other similar cards). For purchases in Spain, the card used for payment must be issued by a Spanish bank or savings bank. 

The gtiberia.com website has the highest security measures commercially available in the sector. In addition, the payment process works on a secure server using the SSL (Secure SocketLayer) protocol. 

This safe server establishes a connection so that the information is transmitted encrypted by means of algorithms, that assure that only it is intelligible for the computer of the user and the one of the Web site of this form, when using the protocol SSL is guaranteed: 

1. That the user is communicating their data to the GTI server centre and not to any other that might try to impersonate it. 

2. That between the user and the aforementioned server centre the data is transmitted encrypted, avoiding its possible reading or manipulation by third parties. Likewise, GTI declares that it does not have access to confidential data relating to the means of payment used. 

Only the Stripe payment gateway has access to this data for the management of payments and collections, which is inaccessible to other third parties. The user must immediately notify GTI of any undue or fraudulent charge on the card used for purchases, by email or telephone, as soon as possible so that the appropriate steps can be taken.

Shipping costs

Shipping costs depend on the total amount of the purchase and the delivery point, which are calculated at the time of purchase. Shipping costs may be assumed by GTI if this advantage is specified within a promotion. These shipping cost promotions are usually subject to the purchase of a minimum amount. 

In Spain, shipments to the Canary Islands, Ceuta and Melilla will be subject to customs and/or import charges in addition to the amount of the order: 

  • – In the Canary Islands (approx.) 18€ DUA + 7% IGIC . 
  • – In Ceuta and Melilla (approx.) 18€ DUA + 7% clothing /10% footwear IPSI. 

In national shipments to Spain, customers will assume the corresponding customs and/or import costs, if any.

Discount Codes

GTI promotions or discount codes are not cumulative, and are limited to one per person per online order. 

Only one discount code can be used per order and per shopping cart. In other words, they can be used on a single purchase of one or more products purchased through the website. 

Discount codes are non-refundable and cannot be exchanged for cash. 

Terms and conditions regarding the validity of the code are included with each purchase. 

If you have a promotional code you will be able to use it before finalising your order in the ‘Summary of your purchase’. Enter the promotional code and click ‘Apply discount code’. If the discount code is valid you will see the discount applied in the order summary. 

In case of return or exchange, the value of the code will not be refunded. 

Orders

GTI undertakes to deliver the product in perfect condition to the address provided by the user on the order form. This may be different from the buyer’s address. In order to optimise delivery, we would be grateful if the user could indicate an address to which the order can be delivered during normal working hours. 

GTI shall not be liable for delivery errors caused when the delivery address entered by the user in the order form does not correspond to reality or has been omitted.

Delivery Methods 

SPAIN/PENINSULA For purchases made in Spain this must be included in any case, within the peninsula and / or Balearic Islands. 

– Free shipping costs for purchases of an amount equal to or greater than 50€ for orders destined for the peninsula or Balearic Islands, and 60€ for orders destined for Ceuta, Melilla or the Canary Islands. 

For orders of a lower amount, the standard shipping costs of €4.95 apply in mainland Spain and the Balearic Islands. In the case of Ceuta, Melilla and the Canary Islands, the standard shipping rate is always 15€. 

The order will be delivered within approximately 4 to 5 working days from order confirmation. This period may be longer in periods of sales, Black Friday or specific promotions without the user having the right to claim compensation or compensation for such delay. 

Returns Policy 

1. RIGHT OF WITHDRAWAL 

The Customer has the right to withdraw from his order without having to justify his decision within a period of fourteen (14) calendar days from receipt of the Products ordered, taking as a reference the date appearing on the carrier’s receipt signed by the Customer. In the event that the expiry date of this period of fourteen (14) days coincides with a Saturday, Sunday or public holiday, the period shall be extended to the following working day. 

The right of withdrawal must be exercised by sending an e-mail to customer@gtiberia.com indicating your intention to return the order. The exercise by the consumer and / or user of the right of withdrawal entails the automatic termination of the contract at no cost to the consumer, and therefore, the return by GTI of the sums paid by the consumer and user, without retention of costs, except for cases where the consumer has expressly selected a delivery method other than the least expensive mode of ordinary delivery, in which case the entrepreneur will not be obliged to reimburse the additional costs arising therefrom. 

The reimbursement of these sums shall be carried out without undue delay and in any case not later than 14 calendar days after GTI has been informed of the consumer and user’s decision to withdraw from the contract. 

The exercise of the right of withdrawal entails the obligation of the consumer to return the product to GTI, in the same conditions in which he/she received it, no later than 14 calendar days from the date on which he/she communicates his/her decision to withdraw from the contract. 

GTI may therefore withhold the refund until it has received the goods or until the consumer has provided proof of the return of the goods. 

In order to be able to exercise the right of withdrawal, the product must be returned in the same conditions in which it was received, so no refund will be made in those cases in which the product is in a different condition or has suffered any deterioration, impairment or damage. 

The refund will be made by the same means of payment with which it was initially paid, unless the consumer has expressly provided otherwise, and provided that the consumer does not incur any costs as a result of the refund. 

2. GENERAL RETURN CONDITIONS 

Without prejudice to the rights arising from the regulations on withdrawal and independently and in addition to this, if for any reason the user is not satisfied with the order, has received another product by mistake or has any kind of defect, you can return it within 30 days from the date of delivery. 

There are several conditions that the product must meet in order to be returned: 

  • ∙ It must not be used. 
  • ∙ It must not have been damaged in any way. 
  • ∙ It must be in its original packaging. 

The delivery of several products must be made in the same box in which it was delivered or in a similar format. 

To make the return from your home access the information of your order and request the return. The steps to follow are described in section b) of this clause “Return procedure”. 

Return Procedure 

The deadline for making a return free of charge is thirty (30) calendar days from receipt of the order. 

Return from your home. 

Follow the steps below to request a free collection from your home: 

Step 1: Communication. 

Send an email to cu@gtiberia.com indicating the article or articles you wish to return. You will receive an email with the location of the transport agency. If for some reason you prefer to send it on your own, please send it to the address indicated above. In this case, you will have to pay the return shipping costs, as we do not accept any parcels sent carriage forward. 

Step 2: Prepare your return. 

Place the items you wish to return in a box together with the delivery note. If you do not have the delivery note, you can also print the order confirmation email or, if you are a registered user on the website, the order receipt that you will find in the “My account” section. 

Don’t forget to include any of these receipts in your return package. Otherwise, it will be impossible for us to identify you and complete the refund successfully. 

Step 3 Delivery.

Hand over the closed and correctly packed package to the carrier. 

Step 4: Refund.

Once we receive your return in our warehouse, the Customer Service department will contact you to confirm the refund. 

From the time the transport company collects the item(s) and we check that everything is correct until we refund the corresponding amount, it may take between 4 and 10 working days depending on the transport time to the warehouse. 

Once the money has been returned, in less than 48 hours you will see the refund reflected in your credit card statement or in your bank account if you paid with a debit card, the time may vary depending on the financial institution issuing the card.

Refund 

GTI will refund the relevant amount, including the standard shipping costs of the initial delivery without undue delay and, in any event, no later than 14 calendar days from the date on which it has received the return or from the date on which proof of return of the goods has been provided, whichever is the earliest. The refund shall be made by the same means of payment with which it was paid. 

Guarantee For Defective Products 

If you contract as a consumer and user, we offer guarantees on the products that we sell through this website, in the terms legally established for each type of product, responding, therefore, for the lack of conformity of the same that are manifested within two years from the delivery of the product.

It is understood that the products are in conformity with the contract as long as they 

(i) they conform to the description given by us and possess the qualities that we have presented on this website, 

(ii) they are fit for the uses for which products of the same type are normally intended and they have the quality and performance which are customary for a product of the same type and which can reasonably be expected. 

In this sense, if any of the products do not comply with the contract, you must inform us by any of the means of communication provided for this purpose. 

Intellectual and industrial property 

GTI is the exclusive owner of the rights relating to its website and its social networks, therefore, all content, graphic design and codes that are part of https://gtiberia.com/ and its domains are the exclusive property of GTI. 

Their reproduction, distribution, public communication, transformation or any other activity carried out with the contents is prohibited, even if the sources are cited, except with the prior, express and written consent of GTI. Therefore, they are protected by the Intellectual Property Law. 

GTI does not grant any authorisation of use of any kind over its intellectual and industrial property rights or over any other property or right related to the website, and in no case shall it be understood that access and browsing by users implies a waiver, transmission, licence or total or partial transfer of said rights by GTI. 

Any use of these contents not previously authorised by GTI will be considered a serious breach of intellectual or industrial property rights and will give rise to the legally established responsibilities.

GTI reserves the right to take appropriate judicial and extrajudicial action against the user. 

Data protection and confidentiality

GTI is responsible for the treatment of all its clients’ data, which is why the company has a Register of Treatment Activities in which it indicates how its clients’ data is treated. 

Likewise, GTI guarantees privacy and confidentiality in the processing of its customers’ data for the purposes of e-commerce and electronic contracting. 

In compliance with current legislation, GTI informs that the data will be kept for the time strictly necessary to comply with the services provided and legal obligations. 

Likewise, the data will be treated in a lawful, loyal, transparent, adequate, pertinent, limited, exact and updated manner. For this reason, GTI undertakes to adopt all reasonable technical and security measures to ensure that the data is deleted or rectified without delay when it is inaccurate or untrue. 

In accordance with data protection regulations, you may exercise your rights of access, rectification, limitation of processing, deletion, portability and opposition to the processing of your personal data, as well as waive the consent given for the processing of the same, the request should be sent to the following email address: customer@gtiberia.com 

Exclusion of liability 

The performance by GTI of all or part of its obligations shall be suspended in the event of an act of God or force majeure preventing or delaying performance. 

The following will be considered as such, in particular, without this list being limitative: war, pandemic, riots, insurrection, social disturbances, strikes of any nature and supply problems not attributable to the same. 

GTI shall inform the Customer of such an act of God or force majeure within seven days of its occurrence. In the event that this suspension is prolonged beyond a period of fifteen days, the client will then have the possibility of cancelling the current order and will then be reimbursed under the conditions foreseen in the present General Purchase Conditions or in those others that the applicable regulations could, where applicable, establish. 

Reservation of the right to modify the general terms and conditions of contracting

GTI reserves the right to modify these general terms and conditions in order to adapt them to any changes or new regulations, for technical reasons, due to changes in the services offered by GTI or due to strategic decisions. 

In these cases, the changes to be made to the data protection policy and the date from which they will take full effect will be announced on this website with reasonable notice.

Any changes will not affect orders that are already in progress. If the user does not agree with the changes, he/she must stop using the website. The use of the website after the changes have been made shall constitute acceptance of the changes by the users.
